The Association of Corporate Counsel (ACC) and Corpedia Corporation (Corpedia) jointly administered the biennial Compliance Program and Risk Assessment Benchmarking Survey during November and December of 2009. The results were analyzed and reported on in 2010.

Some Key Findings:

  • More organizations are communicating with their Board on compliance-related issues, yet fewer are training their Board on compliance. While nearly half of the respondents (48 percent) communicate with their boards on a quarterly basis, many have reduced the time committed to training their board on compliance and ethics issues since the 2007 survey. In 2009, 42 percent of respondents report training for less than one hour, while 2007 saw 74 percent training their board for at least one hour.
  • Those conducting formal code of conduct training are experiencing an increase in completion rates. While fewer respondents report that their organizations provide formal employee training programs than in 2007, respondents whose organizations provide code of conduct training report higher completion rates as a percentage of their total workforce. In addition, respondents frequently report training on sexual harassment, general ethics and conflicts of interest issues in addition to code of conduct training.
  • The planning and implementation of compliance programs is met with growing confidence. Respondents in 2009 identify fewer pressing challenges in regards to planning or implementing their compliance and ethics program than in 2007 or 2005. However, 2009 respondents still
    struggle with the complexity of the regulatory and legal environment, as well as a lack of adequate financial resources.
